Terms of service
Terms of Service
These Terms of Service govern access to and use of the SpotMind website, products and related services.
By visiting the website, creating an account, submitting an order or using any SpotMind service, the customer agrees to these Terms of Service, together with the Privacy Policy, Return and Refund Policy, Shipping Policy and any additional conditions presented during checkout.
Customers who do not agree to these terms should not use the website or place an order.
Nothing in these Terms of Service limits any consumer rights or legal protections that cannot be excluded under applicable law.
1. Eligibility
Customers must be legally capable of entering into a binding purchase agreement.
Customers who have not reached the legal age of majority in their jurisdiction may use the website only with the involvement and authorization of a parent or legal guardian.
By placing an order, the customer confirms that:
- The information provided is accurate and complete;
- The customer is authorized to use the selected payment method;
- The order is being placed for lawful purposes;
- The customer has reviewed the relevant product information;
- The customer accepts these Terms of Service.
2. Website Use
The SpotMind website may only be used for lawful shopping and informational purposes.
Customers must not:
- Use the website for fraud, abuse or unlawful activity;
- Submit false, misleading or incomplete information;
- Use another person’s identity or payment information without authorization;
- Interfere with the operation, security or availability of the website;
- Attempt to access restricted accounts, systems, databases or servers;
- Introduce viruses, malware or other harmful code;
- Circumvent purchase limits, promotional restrictions or security controls;
- Scrape, harvest or automatically extract website content without permission;
- Infringe the intellectual-property, privacy or other rights of another person;
- Use the website for unauthorized commercial resale;
- Create multiple accounts to improperly obtain discounts, gifts or promotional benefits.
SpotMind may restrict, suspend or terminate access when there is reasonable evidence of fraud, abuse, unlawful conduct or repeated violation of these terms.
3. Customer Accounts
Some features may require customers to create an account.
Customers are responsible for:
- Providing accurate account information;
- Keeping account details current;
- Protecting passwords and login credentials;
- Restricting unauthorized access to their devices;
- Promptly reporting suspected unauthorized account activity.
Customers should contact support@spotmind.shop if they believe their account or payment information has been compromised.
SpotMind may suspend or close accounts associated with fraudulent transactions, security threats, payment abuse or repeated policy violations.
4. Product Information
SpotMind makes reasonable efforts to ensure that product descriptions, photographs, specifications, measurements, prices and availability information are accurate.
However, actual product colour, finish, size, texture or appearance may vary slightly because of:
- Screen and display settings;
- Lighting and photography conditions;
- Manufacturing tolerances;
- Material variations;
- Product improvements;
- Packaging changes;
- Differences between production batches.
Minor variations that do not materially affect normal product functionality do not automatically constitute a defect.
If a material product-description error is discovered after an order is submitted, SpotMind may contact the customer to offer a correction, replacement, cancellation or refund, as appropriate.
5. Product Functionality
SpotMind products are intended to assist users in locating compatible personal belongings.
Performance may depend on factors outside SpotMind’s direct control, including:
- Device compatibility;
- Phone or tablet settings;
- Bluetooth or wireless connectivity;
- Internet access;
- Battery or charging condition;
- Signal strength and range;
- Physical obstacles;
- Nearby interference;
- Third-party software;
- Operating-system updates;
- Account configuration;
- Environmental conditions.
SpotMind does not guarantee uninterrupted, instantaneous, continuous, real-time or unlimited-distance tracking.
Location information may occasionally be delayed, approximate, incomplete or unavailable.
6. Compatibility Requirements
Customers are responsible for reviewing compatibility requirements before purchasing a product.
Certain products may require:
- A compatible smartphone, tablet or other device;
- A supported operating system;
- Bluetooth or another wireless connection;
- Internet access;
- A third-party account or application;
- Location, privacy or network permissions.
SpotMind cannot guarantee permanent compatibility with every device, operating system or third-party service.
Compatibility may change because of updates or decisions made by device manufacturers, software developers, network providers or other third parties.
7. Responsible and Lawful Use
SpotMind products must be used responsibly and in accordance with applicable law.
Products must not be used to:
- Secretly track another person;
- Monitor someone without lawful authorization;
- Facilitate harassment, stalking or intimidation;
- Invade another person’s privacy;
- Support any unlawful activity.
The customer is responsible for ensuring that their use of the product complies with local privacy, surveillance and personal-safety laws.
8. No Safety-Critical Reliance
SpotMind products are consumer-location accessories.
They are not intended to replace:
- Physical locks;
- Insurance;
- Professional security systems;
- Emergency services;
- Responsible supervision;
- Specialized safety or medical equipment;
- Professional tracking services.
Customers should not rely on SpotMind as the only method for protecting valuable, essential or safety-critical belongings.
SpotMind does not guarantee that a lost or stolen item will be located, recovered or returned.
9. Prices
Prices are displayed in the currency shown on the website or during checkout.
SpotMind may change prices before an order is accepted.
Price changes will not normally affect orders already accepted, except where:
- An obvious pricing error occurred;
- A technical malfunction affected the displayed price;
- Taxes or charges were calculated incorrectly;
- The customer requests a change to the order;
- Applicable law requires a correction.
Unless expressly stated otherwise, displayed prices may not include import duties, customs charges or fees imposed by local authorities.
10. Promotions and Discounts
Discounts, bundle offers, free gifts and promotional campaigns may:
- Be available for a limited period;
- Apply only to selected products;
- Be limited by quantity or availability;
- Be limited to one use per customer, account, address or household;
- Require a minimum purchase;
- Apply only in selected countries or regions;
- Exclude taxes, duties or shipping charges.
Promotional offers cannot be combined unless expressly stated.
SpotMind may cancel or adjust promotional benefits obtained through:
- Multiple accounts;
- False customer information;
- Automated ordering;
- Discount-code manipulation;
- Repeated returns intended to retain free promotional items;
- Other forms of promotional abuse.
When only part of a promotional bundle is returned, the refund may be recalculated based on the regular price of the products retained by the customer.
11. Order Submission and Acceptance
Submitting an order constitutes an offer to purchase the selected products.
An automatic order-confirmation email confirms that SpotMind received the order, but it does not necessarily mean the order has been finally accepted.
An order is generally accepted when SpotMind confirms fulfilment or dispatch.
SpotMind may refuse, limit or cancel an order because of:
- Suspected fraud;
- Unauthorized payment;
- Product unavailability;
- Pricing or technical errors;
- Promotional abuse;
- Unusual purchasing activity;
- Commercial resale concerns;
- Delivery restrictions;
- Incorrect or incomplete information;
- Violation of these Terms of Service.
If SpotMind cancels a paid order, the applicable amount will be refunded to the original payment method.
12. Order Verification
SpotMind or its payment partners may request additional information to verify:
- Customer identity;
- Billing information;
- Delivery information;
- Payment authorization;
- Unusual transaction activity;
- High-risk or high-value orders.
Failure to complete reasonable verification may result in delayed processing or cancellation.
Verification procedures are intended to protect customers and SpotMind against fraud and unauthorized transactions.
13. Payments
Customers must provide accurate and complete billing information.
By submitting payment details, the customer confirms that they are authorized to use the selected payment method.
Payments may be processed by third-party payment providers. A transaction may be delayed, declined or cancelled because of:
- Incorrect payment information;
- Insufficient funds;
- Bank restrictions;
- Payment-provider restrictions;
- Geographic limitations;
- Fraud-prevention checks;
- Identity-verification requirements;
- Technical failure.
Temporary authorization holds are controlled by the customer’s bank or payment provider and may remain visible after an unsuccessful or cancelled payment attempt.
14. Order Changes and Cancellations
Customers should contact support@spotmind.shop as soon as possible to request a change or cancellation.
Changes and cancellations cannot be guaranteed after fulfilment begins.
Once an order has been processed, packed, transferred to a fulfilment partner or dispatched, the customer may need to wait for delivery and submit a return request under the Return and Refund Policy.
An order is not considered cancelled until SpotMind provides confirmation.
15. Shipping and Delivery
Delivery estimates are provided for guidance and are not guaranteed delivery dates unless expressly confirmed otherwise.
Delivery may be affected by:
- Carrier delays;
- Customs processing;
- Severe weather;
- Public holidays;
- Local transportation disruptions;
- Incorrect address information;
- Failed delivery attempts;
- International shipping delays;
- Events outside SpotMind’s reasonable control.
Customers are responsible for providing a complete and accurate delivery address.
SpotMind is not responsible for delays or failed delivery caused by incorrect, incomplete or outdated information supplied by the customer.
Mandatory delivery rights under applicable consumer law remain unaffected. Consumers in the EU, for example, are entitled to clear information about products, prices, shipping costs and their rights when problems occur.
16. Customs, Duties and Taxes
International orders may be subject to:
- Import duties;
- Customs charges;
- Value-added tax;
- Brokerage fees;
- Local processing charges;
- Other government-imposed fees.
Unless these charges are expressly included during checkout, they are the customer’s responsibility.
SpotMind does not control customs assessments and cannot guarantee whether charges will apply or how much they will be.
Refusing a parcel because of customs charges does not automatically qualify the order for a full refund. Return transportation, customs or carrier costs may be deducted where permitted by law.
17. Returns and Refunds
Returns, refunds, replacements and exchanges are governed by the SpotMind Return and Refund Policy.
Customers must contact SpotMind and obtain return instructions before sending a product back.
Receiving return authorization does not automatically guarantee a refund. Returned products may be inspected to confirm:
- Product identity;
- Product condition;
- Completeness;
- Included accessories;
- Reported defects;
- Compliance with return requirements.
Nothing in these terms limits mandatory rights relating to faulty, damaged, misdescribed or undelivered products.
18. Product Care and Safety
Customers must read and follow all instructions supplied with the product.
The SpotMind card should be protected from:
- Excessive heat;
- Fire;
- Water and prolonged moisture;
- Crushing, bending or strong impact;
- Improper storage;
- Unauthorized disassembly;
- Incompatible charging equipment;
- Physical modification;
- Use outside the stated product specifications.
Customers should stop using the product if it becomes swollen, excessively hot, physically damaged, burned, leaking or otherwise appears unsafe.
Damage caused by misuse, accidents, unauthorized modification or failure to follow instructions is not considered a manufacturing defect, except where applicable law provides otherwise.
19. Warranty and Guarantee Claims
Any commercial warranty or guarantee offered by SpotMind is additional to mandatory consumer rights.
A warranty or guarantee claim may require:
- Valid proof of purchase;
- The original order number;
- Photographs or videos;
- A description of the issue;
- Completion of reasonable troubleshooting steps;
- Return of the affected product.
Unless expressly stated otherwise, coverage does not normally apply to:
- Accidental damage;
- Normal wear;
- Cosmetic damage that does not affect functionality;
- Water or moisture damage;
- Improper charging;
- Unauthorized repair or modification;
- Misuse;
- Loss or theft;
- Damage caused by incompatible devices or accessories.
Any reference to a Lifetime Guarantee is subject to the specific guarantee conditions made available by SpotMind and does not replace mandatory statutory rights.
20. Troubleshooting
Before approving a defect or replacement claim, SpotMind may request reasonable troubleshooting, including:
- Confirming device compatibility;
- Updating software;
- Reviewing phone or application settings;
- Reconnecting or resetting the product;
- Charging the product;
- Providing photographs or videos.
Troubleshooting requirements do not remove any mandatory rights relating to defective products.
21. Third-Party Services
SpotMind products and website features may interact with third-party:
- Devices;
- Applications;
- Operating systems;
- Wireless networks;
- Payment providers;
- Shipping carriers;
- Analytics platforms;
- Online services.
SpotMind does not control third-party services and is not responsible for their:
- Outages;
- Account restrictions;
- Software updates;
- Compatibility changes;
- Security incidents;
- Policy changes;
- Discontinued functionality;
- Data-processing practices.
Customers may be required to accept separate third-party terms and privacy policies.
22. Customer Reviews and Submitted Content
Customers may submit reviews, photographs, videos, testimonials, questions or feedback.
Customers retain ownership of their original content but grant SpotMind a non-exclusive, worldwide, royalty-free license to display, reproduce and use that content for legitimate store, support and marketing purposes, subject to applicable privacy law.
Customers must not submit content that:
- Is knowingly false or misleading;
- Infringes another person’s rights;
- Contains confidential or sensitive information;
- Contains unlawful, threatening or abusive material;
- Includes malicious software;
- Misrepresents the customer’s genuine experience.
SpotMind may moderate or remove content that violates these terms.
Nothing in these Terms prevents customers from publishing honest reviews or genuine opinions about SpotMind products or services.
23. Intellectual Property
All SpotMind website content, including branding, trademarks, logos, text, photographs, graphics, videos, icons, website layouts, product illustrations, software and product designs, belongs to SpotMind, its affiliates or its licensors.
Customers may access this content for personal shopping purposes.
Without prior written permission, customers may not:
- Copy or republish website content;
- Modify or distribute product photographs;
- Use SpotMind branding commercially;
- Remove copyright or trademark notices;
- Create misleading copies of the website;
- Impersonate SpotMind;
- Register confusingly similar trademarks, business names or domains;
- Use SpotMind content to promote competing products.
24. External Links
The website may contain links to third-party websites or services.
These links are provided for convenience and do not necessarily represent endorsement.
SpotMind does not control and is not responsible for the accuracy, availability, security, content or privacy practices of third-party websites.
25. Website Availability
SpotMind aims to keep the website available and functioning correctly but does not guarantee uninterrupted access.
The website may be unavailable because of:
- Maintenance;
- Software updates;
- Hosting problems;
- Network failures;
- Cybersecurity incidents;
- Third-party interruptions;
- Events outside SpotMind’s reasonable control.
SpotMind may modify, suspend or discontinue website features when reasonably necessary.
26. Errors and Corrections
The website may occasionally contain typographical, pricing, availability, product-description or technical errors.
SpotMind may correct errors and update information when reasonably necessary.
If an error materially affects an order, SpotMind may:
- Contact the customer for confirmation;
- Correct the order with the customer’s approval;
- Cancel the affected product;
- Provide a refund.
SpotMind will not use this section to avoid an accurately confirmed order merely because the business later regrets the displayed price.
27. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the website and non-mandatory online services are provided on an “as available” basis.
SpotMind does not guarantee that:
- The website will always operate without interruption;
- Every technical error will be corrected immediately;
- Third-party services will remain available;
- Location information will always be exact or real-time;
- Products will prevent loss or theft;
- A missing item will be recovered;
- Every device will remain compatible indefinitely.
This disclaimer does not exclude:
- Express promises made by SpotMind;
- Applicable commercial guarantees;
- Mandatory implied warranties;
- Rights relating to faulty or misdescribed products;
- Legal protections that cannot be excluded.
28. Limitation of Liability
To the maximum extent permitted by law, SpotMind is not responsible for indirect, incidental, special or consequential losses arising from:
- Loss or theft of personal belongings;
- Failure to recover a missing item;
- Tracking delays or inaccuracies;
- Device incompatibility;
- Third-party service interruptions;
- Internet or wireless failures;
- Improper product use;
- Failure to follow instructions;
- Website interruptions;
- Delivery delays outside SpotMind’s reasonable control.
Where legally permitted, SpotMind’s total liability relating to a product or order will not exceed the amount paid for the affected product.
Nothing in these terms excludes or limits liability for:
- Fraud or fraudulent misrepresentation;
- Death or personal injury where liability cannot legally be excluded;
- Faulty or misdescribed products where mandatory law applies;
- Any other liability that cannot legally be limited or excluded.
29. Fraud and Abuse Prevention
SpotMind may investigate transactions involving suspected:
- Payment fraud;
- Identity theft;
- Chargeback abuse;
- False non-delivery claims;
- False defect claims;
- Product substitution;
- Promotion manipulation;
- Unauthorized account access;
- Repeated abusive returns.
SpotMind may request reasonable evidence or identity verification before processing an order, claim, replacement or refund.
SpotMind may cooperate with payment providers, delivery companies, insurers and lawful authorities when investigating suspected fraud.
30. Payment Disputes and Chargebacks
Customers are encouraged to contact support@spotmind.shop before opening a payment dispute so SpotMind has an opportunity to investigate and resolve the issue.
Opening a payment dispute does not automatically cancel:
- The order;
- Return requirements;
- Delivery obligations;
- The requirement to provide accurate evidence.
SpotMind will not issue duplicate compensation when reimbursement has already been provided by a bank, payment provider, insurer or dispute process.
Nothing in this section limits a customer’s lawful right to dispute an unauthorized or unresolved transaction.
31. Force Majeure
SpotMind is not responsible for delays or failure caused by events outside its reasonable control, including:
- Natural disasters;
- Severe weather;
- Fire;
- War;
- Civil unrest;
- Government action;
- Public-health emergencies;
- Labour disputes;
- Customs disruption;
- Transportation interruption;
- Power failures;
- Telecommunications failures;
- Supply-chain disruption.
SpotMind will make reasonable efforts to minimize the effect of such events and fulfil, replace or refund affected orders where required by law.
32. Suspension and Termination
SpotMind may suspend or terminate website access where a customer:
- Violates these terms;
- Uses the website unlawfully;
- Engages in fraud or abuse;
- Threatens website security;
- Infringes another person’s rights;
- Repeatedly submits dishonest claims.
Termination does not affect rights or obligations that arose before termination, including valid payment, return, refund or consumer-protection rights.
33. Severability
If any provision of these Terms of Service is found to be invalid, unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue in effect where legally possible.
34. No Waiver
If SpotMind does not immediately enforce a provision of these terms, that does not mean SpotMind permanently waives the right to enforce it later.
Any waiver must be clear and authorized.
35. Entire Agreement
These Terms of Service, together with the policies referenced on the website and any conditions presented during checkout, form the agreement between SpotMind and the customer concerning the relevant order or website use.
They replace previous discussions or representations concerning the same subject, except for express promises or mandatory legal rights that cannot be excluded.
36. Electronic Communications
By using the website or contacting SpotMind electronically, customers agree that order confirmations, shipping notices, security messages, refund information and other service communications may be provided electronically.
Customers are responsible for maintaining a valid email address and reviewing messages relating to their order.
37. Applicable Law and Consumer Rights
These terms are subject to applicable contract, e-commerce and consumer-protection laws.
Customers may benefit from mandatory rights in the country or region where they live. Nothing in these terms requires customers to waive protections that cannot legally be waived.
Standard consumer-contract terms that create an unfair imbalance may be unenforceable in certain jurisdictions.
38. Dispute Resolution
Customers should first contact SpotMind so both parties have an opportunity to resolve the concern directly.
Nothing in this section prevents a customer from:
- Exercising mandatory consumer rights;
- Contacting a consumer-protection authority;
- Using an available payment-dispute process;
- Bringing a claim before a competent court;
- Using another legal remedy available in their jurisdiction.
39. Changes to These Terms
SpotMind may update these Terms of Service to reflect:
- Changes to products or services;
- Website improvements;
- Security requirements;
- Business practices;
- Legal or regulatory obligations.
Updated terms will apply from the time they are published.
Changes will not retroactively remove rights relating to an order already accepted unless required by law or expressly agreed with the customer.
40. Contact Information
